The term “ecocide” first emerged during the Vietnam War, used to describe the destructive environmental consequences of the defoliant Agent Orange. After featuring in United Nations talks during the following decades, by 1998, ecocide had been proposed as an international crime against peace in a draft of the Rome Statute, the treaty that created the ICC.

There is "a clear legislative direction of travel" in several national jurisdictions, at a regional level in the European Union and even at a global level, where progress is made "towards the recognition of #ecocide ."

While several climate activists have been sent to prison for their involvement in disruptive protests, legislation is now also being strengthened to impose criminal sanctions on individuals found responsible for large-scale environmental damage.

Ecocide law gives us the opportunity to bridge the gap between what existing legal instruments can achieve and what the science is telling us must be done.

Humans have this deep separation from nature, that gives us a kind of cultural inability to recognize the severity of what it means when we harm the natural world. We have a large number of environmental laws around the world, and what we’re seeing is that they’re not effective or adequate to address global, ecological, and climate crisis.

The Scottish Government has been urged to show “much-need global leadership” at COP28 and harness its work on loss and damage into efforts to tackle ecocide. The appeal comes after delegates unexpectedly agreed to set up a global loss and damage fund on the first day of COP28 in Dubai, with at least $400m pledged so far.

New EU "Ecocide" crime agreed. Perpetrators could face at least 10 years in prison while companies could be hit with fines as high as €40 million per offence.

The motion, which reportedly received cross-party support from councilors, calls for ecocide to be recognised as a crime which damages the environment and endangers the future of the planet.

An amendment to the Rome Statute could have a ‘catalysing’ impact across nations to formulate their own laws; individual nations enshrining ecocide in their legislation could, in turn, build up pressure on the ICC.

While damaging the environment is already an offence in most countries, recognition of ecocide elevates the most egregious cases to a crime – with accompanying penalties. A growing number of countries are considering introducing laws to make ecocide a crime.

La Federación de Empresarias y Profesionales de España BPW Spain aprueba la propuesta de la Asociación en Canarias y lanza la iniciativa #FrenaElEcocidio y solicita que se reforme el Código Penal español y se introduzca el delito de ecocidio. Un grupo de expertos, con integrantes de todos los continentes, aboga por la inclusión de lo que sería la quinta categoría de crímenes contra la humanidad. Los principales países implicados, no aceptan la jurisdicción de este tribunal, pero lo mismo representaría un gran avance.

Cada mes desde hace ocho meses ininterrumpidos, la Red Ecosocialista-MST junto a las organizaciones que integran la Asamblea por un mar libre de petroleras y cientos de activistas independientes salen a las calles para denunciar la amenaza que representa la exploración sísmica y la instalación de plataformas petroleras off shore en las costas marplatenses para los ecosistemas marinos y las comunidades costeras.

Rodrigo Lledó, miembro del Panel de Expertos Independientes encargado de la definición de ecocidio, escribe sobre el origen de este término, su historia y la necesidad de incorporarlo cuanto antes al Estatuto de Roma que rige la CPI.

El abogado Matías De Bueno explica que desde la UNR se está elaborando un proyecto académico para incorporar la figura del ecocido al Código Penal: “Cuando se genera un daño de tal magnitud que puede tener consecuencias irreversibles sobre un espacio natural y sobre el ambiente pedimos que se castigue de la forma máxima, con sanciones desde multas o inhabilitación hasta penas de prisión”.

La Asociación de Investigadores de Derecho Penal Ambiental y Climático (AIDPAC), propone incorporar el delito de ecocidio al Código Penal de la Nación con penas de hasta 20 años de prisión para las personas físicas y de suspensión de actividades para las empresas.

La propuesta de un cambio de paradigma para encontrar otra forma de convivir con la naturaleza es más necesaria que nunca si queremos sobrevivir como especie. El derecho sólo es un instrumento que nos puede acompañar en la transición hacia una ecocivilización pero es insuficiente si no hay el convencimiento de este cambio en el imaginario colectivo.

Kenia López Rabadán, senadora por el Partido Acción Nacional (PAN), presentó una iniciativa de reforma para crear el Tribunal Federal Ambiental y con ello frenar el “ecocidio” que está provocando el Tren Maya.

The initial goal is to define ‘ecocide’, and while any formal recognition of the term as a crime in international law could be years away, Dr Rachel Killean, from the School of Law at Queen’s, has based a lot of her research on the merits of changing international law to see ecocide established alongside war crimes, genocide and crimes against humanity by the International Criminal Court (ICC).
